Terms of Service

These Terms of Service ("Terms") govern your use of FamTrust, operated by The BG LLC ("we," "our," or "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use FamTrust.

1. What FamTrust Is

FamTrust is a household financial visibility tool. It connects to financial institutions via Plaid to aggregate account balances, transactions, and liability information in one dashboard, and it lets you share controlled access to that information with trusted household members.

FamTrust is not a bank, broker-dealer, investment advisor, or financial planner. Nothing on FamTrust constitutes financial, legal, or tax advice. All information is for informational purposes only.

2. Eligibility

• You must be at least 18 years old to use FamTrust.
• You must have the legal authority to connect the financial accounts you link. Do not connect accounts you are not authorized to access.
• FamTrust is currently available to US residents only.

3. Your Account

You are responsible for maintaining the security of your account. FamTrust uses passwordless authentication (magic link or Google OAuth) — keep your email account secure. Notify us immediately at privacy@famtrust.life if you suspect unauthorized access.

Your account may belong to more than one household — you can maintain (own, or co-own as a spouse) at most one household, and be an invited member of any number of others. Each household's data is kept separate. You may not share your account credentials or allow another person to use your account.

4. Bank Connectivity (Plaid)

By connecting a financial institution, you authorize FamTrust to retrieve account and transaction data through Plaid on your behalf. This access is read-only — FamTrust cannot move money, make payments, or modify your financial accounts.

You can disconnect any institution at any time from your dashboard. Disconnecting revokes Plaid's access token for that institution.

By using Plaid, you also agree to Plaid's Terms of Service and End User Privacy Policy.

5. Household Members and Roles

As the household owner, you control who has access to your household's information. You are responsible for the access you grant to invited members. You represent that you have the consent of any person whose financial information you are sharing.

Invited members may view data according to the role and permissions you configure. FamTrust enforces access controls at the API level, but you remain responsible for not granting access to untrusted parties.

6. Acceptable Use

You may not use FamTrust to:

• Connect financial accounts you are not authorized to access
• Attempt to reverse-engineer, scrape, or extract data from the service at scale
• Circumvent or test security controls without written authorization
• Upload or transmit malicious code
• Upload documents or content you do not have the right to store, or that are unlawful
• Use the service for any unlawful purpose

You are responsible for the documents you upload (such as scanned estate documents). You represent that you have the right to store them and to share them with the household members you grant access to.

7. Data and Privacy

Your use of FamTrust is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using FamTrust, you agree to the Privacy Policy.

8. Subscriptions and Billing

FamTrust is a paid subscription service. Pricing is displayed at checkout and on our pricing page.

• Free trial — when you first add a financial account, you receive a free 30-day trial of the Registry plan. Connecting Plaid and activating transaction sync starts a separate 30-day trial of the Connected plan. No payment information is required during the trial.
• Subscription plans — after your trial ends, continued access requires a paid subscription. Available plans and current prices are shown at checkout.
• Billing cycle — subscriptions are billed monthly or annually, as selected at checkout. Your subscription renews automatically at the end of each billing period unless you cancel.
• Payment — payment is processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You agree to Stripe's Terms of Service.
• Cancellation — you may cancel at any time from Settings. Cancellation takes effect at the end of the current billing period; you retain full access until then. We do not issue refunds for partial billing periods.
• Grace period — if a payment fails or your subscription lapses, we provide a 7-day grace period before restricting access. You may reactivate by updating your payment method or subscribing again.
• Price changes — we will notify you by email at least 14 days before any price change takes effect. Continued use after the new price takes effect constitutes acceptance.

9. Availability and Accuracy

We work to keep FamTrust accurate and available, but we make no guarantees. Financial data depends on third-party providers (Plaid, financial institutions) and may be delayed, incomplete, or occasionally incorrect. Do not rely solely on FamTrust for financial decisions.

We may modify, suspend, or discontinue any part of the service at any time, with or without notice.

10. Disclaimer of Warranties

FamTrust is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, The BG LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of FamTrust, even if we have been advised of the possibility of such damages. Our total liability to you for any claim will not exceed the greater of $100 or the amount you paid us in the 12 months before the claim arose.

12. Indemnification

You agree to indemnify and hold harmless The BG LLC from any claims, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of FamTrust.

13. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes will be resolved in the courts of North Carolina.

14. Changes to These Terms

We may update these Terms as the product evolves. For material changes, we will notify you by email at least 14 days before the change takes effect. Continued use of FamTrust after the effective date constitutes acceptance of the revised Terms.
